VanDerGinst Files Additional Hepatitis A Cases
Tuesday, October 6, VanDerGinst Law filed five more lawsuits on behalf of individuals who contracted the Hepatitis A virus due to exposure at the Milan McDonald’s restaurant. Defendants in the lawsuits are McDonald’s Corporation and the local franchise owner, JKLM, Inc. The lawsuits allege that the Defendants are liable for damages to the Plaintiffs based upon legal theories of negligence, strict liability and breach of warranty. These lawsuits come on the heels of six previous lawsuits filed last week by VanDerGinst Law. The law firm is also investigating on behalf of an additional six clients who may have valid claims. Of the twenty nine reported cases of Hepatitis A alleged to have originated from the Milan McDonald’s, VanDerGinst Law is representing twenty claimants.
VanDerGinst Embarks on National Campaign To Represent Victims of Yaz, Yasmin and Ocella
VanDerGinst Law is now representing woman who have been injured by using birth control pills Yaz, Yasmin or Ocella. The FDA has said that these drugs may cause blood clots and other serious heart and health problems.
Hepatitis A Lawsuits Filed
Wednesday, September 30th VanDerGinst Law filed six lawsuits on behalf of individuals who contracted the Hepatitis A Virus. The complaints allege that the exposure to the virus occurred at the Milan McDonald’s restaurant. The named defendants are McDonald’s Corp and JKLM, Inc., the local franchise owner. The lawsuits allege three theories of liability: negligence, strict liability and breach of warranty.
Each plaintiff was damaged in different ways and to differing extents. All have incurred medical expenses. Some have had protracted hospital stays. Some have incurred lost wages. All have suffered the pain and misery that accompanies the virus. Many, if not all, are exposed to further complications as a result of exposure, including the possibility of having to have their gallbladder removed.
The lawsuits were filed in order to protect the plaintiffs’ rights to a reasonable resolution to their claims and so that further discovery can be accomplished. The law firm is hopeful that the Defendants will accept their responsibility in this matter and that ultimately these lawsuits can be amicably resolved. Article on Quad City Times.

Attorney Tabitha Young was recently admitted to the Iowa Bar. Ms. Young is also admitted to practice law in Illinois and California. The focus of her practice is personal injury law.
Sexual Assault in Nursing Home Prompts Lawsuit
VanDerGinst Law has filed a multi-count lawsuit against Parkview Terrace, an East Moline, IL nursing home. The lawsuit alleges negligent hiring, negligent supervision and negligent security with respect to the sexual assault of one of its residents by an employee, Paul De Hubbard, on 2/01/09.
VanDerGinst Law represents the nursing home resident, an 82 year old woman who was sexually assaulted by Hubbard. The woman’s identity has not been disclosed due to the sensitive nature of the allegations.
About the case, lead attorney, Dennis VanDerGinst, stated, “This is one of the most shocking and disgusting cases I have been involved with. As children and grandchildren we rely on nursing homes to take seriously their responsibility to keep our loved ones safe. They accept money to do so. So, when something like this happens we all have to demand accountability. That is what this lawsuit is all about.”
Hubbard has also been named a defendant in the lawsuit. He was arrested at Parkview Terrace on February 1. 2009, and charges with criminal assault of a person who cannot consent, a Class 1 felony. On 3/26/09, he entered a plea of guilty. On 7/28/09 he was sentenced to four years in the Illinois Department of Corrections with two years mandatory supervised release. VanDerGinst Law Handling Burr Oak Cemetery Cases
VanDerGinst Law is handling claims for families with relatives buried in the Chicago Burr Oak Cemetery. The claims are with respect to the illegal disinterment of hundreds of bodies as the result of a scheme alleged to have been implemented by four cemetery employees who were reselling burial plots after digging up and dumping the bodies of those already laid to rest. The Alsip, IL burial ground is also now the target of several criminal investigations. The four employees have been charged in the desecration scandal.

VanDerGinst Attorneys Representing Quad Cities Hepatitis A Outbreak Victims
VanDerGinst Law is currently representing persons who contracted the Hepatitis A Virus from exposure at a McDonald’s restaurant in Milan, IL. A class action lawsuit has also been filed on behalf of all persons who were exposed to the virus. This Quad Cities Hepatitis lawsuit seeks damages related to costs and inconvenience associated with immunizations necessary to combat the virus. VanDerGinst Law is screening those class action cases and will refer them to the law firm handling that case. However, VanDerGinst Law will only be actively involved in handling cases for those people who were actually made ill, either due to contracting Hepatitis A itself, or made ill from the immunization.

On March 28th attorneys Mike Wassell, Trent Marquis and Tabitha Young attended the "Insurance, Liens and Settlements Seminar" presented by the Illinois Trial Lawyers Association. The seminar was held in Oak Brook Hills, IL. The seminar was designed to help attorneys learn how to maximize settlements and verdicts by negotiating money that has to be repaid to lien holders, treatment providers, insurance companies and Medicare. Young Attends Auto Cases Seminar

Dennis VanDerGinst has been selected, once again, as one of the top trial lawyers in America, by the Multi-Million Dollar Advocates Forum. The forum consists exclusively of attorneys who have obtained multi-million dollar verdicts or settlements, which VanDerGinst has done on numerous occasions. Less than one half of one percent of all attorneys in the United States are selected for this prestigious honor.
VanDerGinst Appointed To Advisory Board
Dennis VanDerGinst was recently appointed to the National Crime Victim Bar Association's Advisory Board. The NCVBA provides technical support to attorneys representing crime victims in civil actions, refers crime victims to lawyers in their local area, and works to increase general awareness about the availability of civil remedies for victims of crime. VanDerGinst Law recently hosted an educational seminar for crime victim advocates, addressing the civil remedies available to their respective clients. The firm has taken an active role in educating crime victim advocates and in assisting victims of crime to obtain compensation for damages they sustained.
Quad City Arts "Sweet Art"
VanDerGinst Law Sponsored the Quad City Arts "Sweet Art" Fundraiser at the Jumers Casino and Hotel. The event featured a silent auction of the art work created by area artists and was held in conjunction with Valentines Day. Proceeds benefited the Quad City Arts.
VanDerGinst Attorneys Attend American Association for Justice Convention
Attorneys Tabitha Young and Dennis VanDerGinst attended the winter conference for the American Association of Justice in New Orleans February 7-11. AAJ is the largest trial lawyers bar association in the country. Its members primarily represent persons who have been harmed by another's wrongdoing. Young and VanDerGinst attended multiple lectures and seminars designed to enhance their knowledge of current legal issues and sharpen their trial skills. VanDerGinst Law was also a sponsor for the "New Lawyer Gala", a large reception for all convention goers.
VanDerGinst Law Hosts Crime Victim Seminar
On Friday, January 30th, VanDerGinst Law hosted an all day seminar presented by the National Crime Victim Bar Association. The seminar attracted approximately 80 crime victim advocates from agencies all over Illinois. The purpose of the seminar was to educate crime victim advocates regarding the possibilities for compensation that exist for victims of crime via the civil justice system. National director, Jeff Dion, outlined general principles of law with respect to crime victim compensation while Dennis VanDerGinst discussed the specific application of Illinois law to those principles. VanDerGinst Selected as Top Trial Lawyer
Dennis VanDerGinst was recently selected as one of the top trial lawyers in the country according to the American Trial Lawyers Association. He has also been included in the Top 100 Trial Lawyers for the state of Illinois. According to the American Trial Lawyers Association, “This recognition is extended only to attorneys who exemplify superior qualifications, trial results, leadership, influence, reputation, stature and profile in the trial attorney community as viewed by our organization, other trial lawyers, members of the bench, and the public at large.” The association conducts an investigation and diligent evaluation of all qualifications before extending an invitation as one of its exclusive members.
VanDerGinst Law Sponsors Trans Siberian Orchestra
Continuing its holiday tradition of "giving back" to the community, VanDerGinst Law sponsored two concerts on Saturday, December 13th performed by the world famous Trans Siberian Orchestra at the i-Wireless Center in Moline, IL. One dollar from each ticket purchased for the concerts went to the Genesis Compassion Fund which raises money for many causes with a focus on providing flu shots for children in area schools. The total amount raised from the two concerts was $19,683. Dennis VanDerGinst had the honor of introducing TSO, and together with a representative of the Genesis Foundation, accepted a check from band members Tony Gaynor and Tommy Farese.
VanDer"Grinch" Holiday Party Huge Success
Friday, December 12, VanDerGinst Law hosted the inaugural VanDer"Grinch" Holiday Party at Modern Woodman Park in Davenport, IA. Among the guests were members of local bar associations, judges and court personnel, client advocacy groups, union representatives, local medical treatment providers and various governmental officers. VanDerGinst Named To National Advisory Board
Dennis VanDerGinst has been selected to serve on the National Advisory Board for the Association of Interstate Trucking Lawyers of America. AITLA is a national association of committed lawyers who have joined together to eliminate unsafe and illegal interstate trucking practices. Through combined efforts in education, litigation and legislation the AITLA is working to make American highways safer for families, clients and all Americans.

On Dec. 6th VanDerGinst Law sponsored "Holiday on the Hill" at the Putnam Museum in Davenport, Ia. VanDerGinst Law was one of the primary sponsors for the Quad City Arts Festival of Trees Parade, held on November 22nd in Davenport, Ia. The parade is the largest helium balloon parade in the world, even exceeding Macy's in number of balloons. Over 70,000 people lined the streets along the parade route, braving near freezing temperatures. For the second year in a row Dennis VanDerGinst was one of three parade marshals selected to lead the parade. The law firm also sponsored a brand new balloon this year, "Judge George", which was escorted along the parade by staff and friends.
VanDerGinst Law, P.C. Welcomes New Attorney
Attorney Tabitha Young has recently joined VanDerGinst Law. She will be working primarily in the civil litigation department of the firm. Ms. Young received her B.A. degree in History from Boston University where she also spent time studying International Law in London. She obtained her Juris Doctorate degree from Pepperdine University School of Law in California where she also worked as a research assistant. Additionally, she has worked as an extern to Judge Robert P. Applegate of the Los Angeles Superior Court. Ms. Young is licensed to practice law in the state of Illinois and will soon gain admission in the states of California and Iowa.
Boo at the Zoo
VanDerGinst Law was proud to sponsor BOO AT THE ZOO at the Niabi Zoo in Coal Valley, IL. On Saturday the 25th and Sunday the 26th of October. Thousands of costumed kids, parents and grandparents flooded the zoo and gathered goodies from dozens of vendor participants. Staff and attorneys from VanDerGinst Law were on hand to share in the festivities. The giraffes, elephants and other animal residents were also there to participate in the festivities!
VanDerGinst Speaks to the Rock Island County Bar Association
Dennis VanDerGinst recently spoke at the Rock Island County Bar Association's fall seminar. His presentation was titled "Anatomy of a Mass Tort". In his presentation he distinguished "mass torts" from "class actions", addressed the "Class Action Fairness Act", outlined the practical and legal considerations relevant to mass tort litigation and discussed the impact of recent Supreme Court decisions relative to federal preemption as a practical defense to mass tort claims.
VanDerGinst Nets Record Recovery
Dennis VanDerGinst recently settled a personal injury claim on behalf of an anonymous local man for $1.2 million. The amount represents the highest reported recovery for an injury of its kind in Illinois and Iowa. Payment of the settlement will be structured in such a way that the plaintiff will actually be guaranteed over $2 million over the course of several years.
The plaintiff, anonymous for privacy reasons, suffered a ruptured left eye requiring a prosthetic implant as a result of a low impact automobile accident. The collision triggered the plaintiff’s airbag to deploy which in turn caused the enucleation of the eyeball. Because the plaintiff’s vehicle was an older model there was no cause of action available against the manufacturer. However, the “at fault” driver had reasonable liability and umbrella insurance coverage which allowed for the settlement.
For this type of injury the settlement amount is the largest ever reported in Illinois, outside of Chicago. And it is the second largest in Illinois history. The only larger recovery in Illinois for this type of injury was reported last year in Chicago. However, that was a high speed collision resulting in multiple facial fractures; surgeries and scarring that were not present in this case.

VanDerGinst Attends Inaugural Trucking Litigation Conference
Dennis VanDerGinst, of VanDerGinst Law, P.C., recently attended the inaugural conference for the Association of Interstate Trucking Lawyers of America. This is a new legal association consisting of attorneys who concentrate a portion of their practice to representing persons who have been harmed by unsafe trucking companies. Due to the vast array of trucking regulations attorneys who practice in this area need specialized training. In addition to his membership in the AITLA VanDerGinst has long been a member of the Interstate Trucking Litigation Section for the American Association for Justice. He has represented plaintiffs in numerous trucking accident cases.
VanDerGinst Moderates Attorney Conference
Dennis VanDerGinst recently moderated a national conference of personal injury attorneys sponsored by Professionally Speaking, Inc., in New Orleans. The conference, entitled “Practices Made Perfect”, addressed practical issues affecting today’s personal injury law firm. Topics included law firm management, client services, and new “hotbeds” of personal injury law. VanDerGinst also spoke on the use of the Internet for the delivery of legal services.

VanDerGinst Law has recently hired Tiffany Tapia in an effort to improve its services to the Hispanic community. Ms. Tapia is fluent in Spanish as well as English and fills the role of legal secretary and intake manager for Spanish speaking clients. She becomes the third bi-lingual specialist for the firm.

Legal-Nurse Consultant Joins VanDerGinst Law
Legal-Nurse Consultant, Tammi Lewis, has recently joined VanDerGinst Law. Ms. Lewis has been a registered nurse for approximately eight years. Her prior experience includes inter-disciplinary care as a case manager in both home and clinical settings, and as a Quad City emergency room nurse. She is a certified Legal-Nurse Consultant and will be working in that capacity at the firm. Her concentration will be devoted primarily to medical malpractice, nursing home negligence, wrongful death and catastrophic injury cases.

Attorney Geoff Campbell has joined the Quad Cities area law firm, VanDerGinst Law, P.C. Mr. Campbell is licensed to practice law in Illinois and the federal courts. New Attorney Joins Firm
VanDerGinst Law, P.C. is pleased to announce John Westensee has joined the firm. Mr. Westensee received his B.S. degree from Iowa State University and his Juris Doctorate from Valparaiso University School of Law. He is licensed to practice in Illinois and Iowa as well as the United States District Court, Southern District of Illinois. Mr. Westensee is a member of the Rock Island County Bar Association, the Illinois State Bar Association and the Iowa State Bar Association.
His practice is primarily focused in the areas of Worker’s Compensation law (hearings and appeals) and Social Security Law (disability claims and hearings).

Wassell Obtains Near-Record Settlement for Clients
VanDerGinst Law attorney Mike Wassell has secured a near-record settlement amount for a personal injury claim in Henderson County, Illinois. He represented three individuals who were seriously injured in an automobile accident. The individual responsible for causing the accident contributed $300,000 of his own funds, in addition to the applicable insurance policy limits of $200,000 in order to settle the case. It is the first reported settlement in the county wherein an individual defendant contributed such a large amount towards settlement in addition to the insurance policy limits.
VanDerGinst Publishes Article on Mass Tort Litigation

VanDerGinst Law, P.C. To Settle Zyprexa Lawsuits
VanDerGinst Law, P.C. is quickly approaching settlement with Eli Lily & Co concerning claims made on behalf of a number of clients who suffered adverse side effects from the drug Zyprexa. Originally created for the long-term treatment of bipolar mania and schizophrenia, the drug was later discovered to cause unintended, harmful side effects. All parties involved are hopeful for a satisfactory conclusion within the next few months.
VanDerGinst To Fill ATLA Post
Dennis VanDerGinst, managing partner of VanDerGinst Law, P.C. has been appointed by the Illinois Trial Lawyers Association as the State Delegate to the Association of Trial Lawyers of America. State Delegates participate in the governance of ATLA and in the recruitment and retention of new members. Only two attorneys are selected to represent each state. Bextra Withdrawn From Market - VanDerGinst Law Investigates Potential Claims
On April 7, 2005, Pfizer suspended all sales of the popular pain killer Bextra in the United States and the European Union after the Food and Drug Administration (FDA) announced that the overall risk versus benefit of Bextra is unfavorable.
The drug is made by Pfizer, the world's largest drug maker, which denies any problem exists with Bextra. However, in a statement on April 7, 2005, Pfizer stated that, "For now, patients should stop taking Bextra and contact their physicians about appropriate treatment options."
VanDerGinst Law has been investigating potential claims against Pfizer for injuries caused by use of Bextra for many months. Managing partner, Dennis VanDerGinst, said in a recent statement, “Our firm is working with a consortium of law firms from across the country to identify victims and represent their interests in hopes of obtaining reasonable compensation.”
The decision to withdraw Bextra, from the market was based on an increase in adverse cardiovascular events shown in Bextra trials, reports of serious and potentially life-threatening skin reactions, including deaths, and lack of any demonstrated advantages for Bextra compared with other non-steroidal anti-inflammatory drugs (NSAIDs).
Bextra (Valdecoxib), may be linked to increased heart attack and stroke risks. Bextra is in the same class of drugs as Vioxx which was withdrawn after studies showed it was too dangerous. These drugs are both Cox 2 Inhibitors, a drug class that many researchers believe interferes with the body's natural ability to reduce blood clots, thereby increasing heart risks. Many doctors believe Bextra presents the same or similar risks as Vioxx.
In addition to being linked to an increase in heart attacks and strokes, Bextra is associated with a skin disorder called Stevens Johnson Syndrome or "SJS". Stevens Johnson Syndrome is a severe allergic reaction and is potentially life threatening.
A November 2004 study, presented to the American Heart Association indicates that patients who take Bextra are more than twice as likely (as non users) to suffer heart attacks or stroke. The study involved 5,930 patients, some taking Bextra and some given a placebo.
Dr. Garret A. FitzGerald, the University of Pennsylvania cardiologist who presented the study to the AHA was quoted in The New York Times saying: "This is a time bomb waiting to go off.... The magnitude of the signal with Bextra is even higher than what we saw in Vioxx."

Pfizer to stop advertising Celebrex
Celebrex, a widely prescribed pain reliever used to treat Arthritis, has been in the spotlight recently due to its link to dangerous cardiovascular side effects. In current years Celebrex has been used as an alternative to other pain relievers because it is gentler on the stomach, but recent cancer-related clinical studies have shown that patients who take this medication are at an increased risk for strokes and heart attacks. The outcome of a study conducted on 2,000 patients taking varying dosages of Celebrex resulted in shocking results which included heart attacks, strokes, and even death among fifteen of the patients.
Vioxx Is Pulled From The Market Because It Has Been Linked To Increased Risk Of Heart Attack, Stroke And Other Serious Health Problems
Vioxx is a brand name used by Merck & Co., Inc. ("Merck") to market and distribute rofecoxib tablets, a nonsteroidal anti-inflammatory prescription arthritis drug. Merck obtained FDA approval on Vioxx in approximately April 1999 via a New Drug Application on a fast-track, 6-month approval process. Merck began distribution and sale of Vioxx throughout the United States in approximately May 1999. Despite knowledge in its clinical trials and post-marketing reports associating Vioxx with hypertension and/or hypertension-related adverse health effects, Merck marketed and promoted Vioxx as safe and effective for persons with hypertension, or persons who had risk factors for stroke or cardiac problems.
On September 30, 2004 Merck has removed Vioxx from the market in all countries because it has been associated with heart attacks, stroke, cardiovascular injuries and other side effects. Merck has removed Vioxx after and and extended study showed that patients using Vioxx double their risk of having a heart attack, stroke or other cardiovascular injury. According to Merck, there are currently approximately 2 million people worldwide taking Vioxx and at least 84 million people have been prescribed Vioxx since it became available on the market in 1999.

VanDerGinst Elected to Board
Attorney Dennis VanDerGinst was recently elected in Boston, to the Board of Trustees for the Roscoe Pound Institute. The Institute, named for Roscoe Pound, Dean of the Harvard Law School from 1916-1936, promotes and protects access to the civil justice system through educational programs, publications, and research. Specifically, it strives to educate state and federal court judges, law professors and law students as well as the members of the bar in general.
Zyprexa Linked to Diabetes and Hyperglycemia
Zyprexa®, also know as Olanzapine has been used to treat schizophrenia and bipolar mania disorders. Doctors have prescribed Zyprexa® to patients with dramatic mood swings such as manic-depressive disorders, in order to help to balance brain chemicals and relieve symptoms. In some patients, there could be an increased risk of developing diabetes and other glucose conditions.
VanDerGinst Law has joined forces with several other large law firms across the country in order to investigate possible claims stemming from this recent revelation. Some possibly related conditions include:

The FDA is now requiring a warning on Zyprexa saying that is linked with diabetes, hyperglycemia and other blood sugar disorders.
Zyprexa's link with diabetes was first exposed on May 3, 2002, when Britain's Medicines Control Agency warned that several patients taking Eli Lilly's top selling drug Zyprexa (used to treat schizophrenia) had developed diabetes-related complications. In the Medicine Control Agency's Current Problems newsletter, the regulatory body said that the anti psychotic drug "can adversely affect blood glucose."
Forty reports "of hyperglycemia (elevated blood sugar), diabetes mellitus, or exacerbation of diabetes have been received in the UK. Four were associated with ketoacidosis and/or coma including one with a fatal outcome," according to the newsletter. "The precise mechanism of this suspected adverse drug reaction has not yet been elucidated and is currently being investigated further.
This follows an emergency report issued in April 2002 by the Japanese Health and Welfare Ministry to Eli Lilly Japan KK concerning side effects of Zyprexa after the deaths of two diabetic users of the drug. It said seven other patients had lost consciousness or become comatose after taking the drugs in the last 10 months. The Japanese Ministry said no new diabetes patients should be treated with the drug and ordered Eli Lilly to warn doctors to closely monitor diabetics already on the medication.

VanDerGinst Nets Record Settlement For Couple
A couple has settled a lawsuit for a Knox County, IL record amount of $4 million. Attorney Dennis VanDerGinst from the law firm of VanDerGinst Law, filed the lawsuit on behalf of Wesley and Virginia England. The lawsuit stemmed from an accident that occurred at People's Do-It Center in Galesburg, IL. People's Do-It Center, Inc. and the corporate giant, Georgia-Pacific Corporation, were named as defendants in the suit. The lawsuit alleged that on 10/3/97, Mr. England was injured while examining paneling that had been stored in an upright display rack. In so doing, the entire stack, somewhere between 25 and 45 panels weighing 28 pounds each, cascaded down upon him, pinning him against the opposite aisle way. As a result, Mr. England has remained in a persistent vegetative state ever since.
The lawsuit further alleged that Georgia-Pacific, the manufacturer of the paneling and distributor of the display racks, knew that it was potentially dangerous to store this particular type of paneling in this upright fashion but failed to warn the retailer. Further allegations were that People's Do-It Center was also aware of the potential hazard, yet failed to remove the hazard, warn of the hazard, or direct employees to assist customers with the paneling.
The defendants denied liability but, nevertheless, ultimately agreed to the settlement. The case was scheduled for trial beginning at the end of February. According to the Illinois Jury Verdict and Settlement Reporter, the settlement is the largest in the history of Knox County, largely out-distancing the second largest reported settlement of $1.275 million.
A statement released by VanDerGinst reveals that a portion of the settlement has been structured to make monthly payments to the Englands for the rest of their lives, insuring that Mr. England/s medical needs will be met without public assistance and that the family will be financially secure without the earnings of Mr. England as the family breadwinner. If both Wesley and Virginia England were to survive to the normal life expectancy, the payout over time would exceed $12 million. Mr. VanDerGinst said, "No amount of money will replace what this family has lost. No mount of money can adequately compensate for what this family has endured. However, this will help make Wesley's life a bit more comfortable and will make the family financially secure."
