Sexual Assault in Nursing Home Prompts Lawsuit

VanDerGinst Law has filed a multi-count lawsuit against Parkview Terrace, an East Moline, IL nursing home. The lawsuit alleges negligent hiring, negligent supervision and negligent security with respect to the sexual assault of one of its residents by an employee, Paul De Hubbard, on 2/01/09.

VanDerGinst Law represents the nursing home resident, an 82 year old woman who was sexually assaulted by Hubbard. The woman’s identity has not been disclosed due to the sensitive nature of the allegations.

About the case, lead attorney, Dennis VanDerGinst, stated, “This is one of the most shocking and disgusting cases I have been involved with. As children and grandchildren we rely on nursing homes to take seriously their responsibility to keep our loved ones safe. They accept money to do so. So, when something like this happens we all have to demand accountability. That is what this lawsuit is all about.”

Hubbard has also been named a defendant in the lawsuit. He was arrested at Parkview Terrace on February 1. 2009, and charges with criminal assault of a person who cannot consent, a Class 1 felony. On 3/26/09, he entered a plea of guilty. On 7/28/09 he was sentenced to four years in the Illinois Department of Corrections with two years mandatory supervised release.
