Protecting Our Civil Liberties

Written By Rohini R.

When James Madison was constructing the Bill of Rights he tried to ensure the basic rights of the American peoples were protected within the first ten amendments. Since then, the legal system of the United States of America has striven to uphold his ideals by preserving the initial ideals set forth by Madison. Our legal system not only advocates the rights of the individual, it protects the liberties of the masses through many different aspects and processes.

One way the legal system of the United States protects and provides for our safety is the series of checks and balances within our government. There is no way a person can take power and completely change our system of government because Madison instilled a process of checks and balances to ensure that from happening. Officials must go through rigorous procedures to change something to certify that it stills stays true to the original framework of our government. The civil liberties guaranteed to us in our Constitution will remain because our legal system strives to hold true to what it symbolizes. The Fifth Amendment, protecting the rights of the accused, will not magically change so that people who are arrested will not have any form of protection from the harsh realities of correctional facilities nor will the Fourth Amendment be ratified so that it is legal for a person to search and seize a person’s property without a warrant. All of those checks and balances are there to protect not only our physical safety, but our emotional well being.

Another way the legal system works to provide for our safety is its close relationship with the law enforcement department. The justice department works to maintain order and establish peace in all social aspects of life. Police provide for the safety of the common person so that they do not have worry about walking at night or simply enjoying their right to go places in their community. They also make sure that the people who are in the correctional facilities are given the opportunity to be rehabilitated so that when they re-released to the public, they are not a danger to society. The law enforcement department goes to great lengths to ensure to physical welfare of the American people.

The third way, and most important, the legal system of our country protects our safety is by allowing the people to observe and interpret the First Amendment however they may choose. Freedom of speech is an amazing right and privilege that Americans have, and the legal system has always supported our license. In a country like America a person can feel safe slandering the state official or expressing their option on our park system because they know that it is their right to do so. The legal system of America provides safety for those who choose to express themselves in a way that does not infringe on the civil liberties of others, and protects those who choose to fight for their causes.

The people of America developed our legal system so it would work for the people of our country. Since the beginning of our nation generation after generation have worked to obtain the goals set forth for them by our founding fathers. As an American, one must respect the work our legal system does to protect the rights of the people, and the safety of the masses. The legal system of American was created over two hundred and twenty five years ago, but it still remains current and pertinent today.
