Vioxx Appeal Comes Out In Merck’s Favor
Today, drug giant Merck found favor in a Texas appeals court. The court reversed a decision finding Merck at fault for the death of a 71-year-old man who took VIOXX. His widow would have received almost $8 million (down from $32 million) in damages and punitive damages.
A press release from the company gives the impression that the appeal is just one of many victories. But a major class action lawsuit is in the works, as VIOXX has been estimated to have killed 38,000 people. (Read a more in depth discussion of this issue here.)
