Negligent Design

Negligent design involves the decision-making process of the manufacturer during the creation of a product. If it can be proven that the product fails to function correctly in its intended condition and provides a danger to the user of the product due to the defect, the product has been rendered hazardous due to negligent design.

In order to prove negligent design, an unreasonable risk or foreseeable injury created through the use of the product, must be shown. Evidence must be provided regarding either:

  • The magnitude of the risk of injury presented by the product's defect plus the reasonableness of the proposed alternative designs, or
  • Other evidence concerning the "unreasonableness" of the risks in the design
